COUNTY OF WILKESHidden Brook Waiver
The undersigned participant hereby covenants, contracts, and agrees with Hidden Brook Sporting Club, LLC, the Dickson Family Living Trust, their heirs, successors, and/or assigns (hereinafter collectively referred to as the ‘Club’) as follows:
(A) That the Participant fully acknowledges that all shooting sports, archery, hiking, and mountain biking carry inherent dangers and risks and agrees to follow all instructions and directions of club staff, guides, instructors, or any other posted rules of conduct;
(B) That the Participant covenants and agrees to hold the Club harmless and indemnify the Club from any and all losses, claims, suits, injuries, or property damage suffered by the Participant which was caused or occasioned by the intentional or negligent act or omissions of any third parties during the designated activities;
(C) That the Participant covenants and agrees to hold the Club harmless and indemnify the Club from any and all losses, claims, suits, injuries, or property damage suffered by any third party as a result of the intentional or negligent acts or omissions of the Participant;
(D) That the Participant warrants that any and all equipment or supplies (gun, shells, bows, bikes, etc.) brought onto Club properties are to the best of the Participant’s knowledge in a safe and proper working order and all safety features are fully operable;
(E) That the Participant covenants and agrees that in addition to the matters identified herein, the Participant agrees to hold harmless and indemnify the Club for any and all expenses including attorney’s fees, court costs, or other expenses associated with the defense of any claim or suit referenced herein;
(F) That the Participant, being fully aware of the inherent risks associated with shooting sports and firearms as well as archery, hiking, and mountain biking in general, hereby assumes all risks associated therewith freely, knowingly, and voluntarily;
(G) That the Participant (or Minor, if applicable) acknowledges their level of experience with firearms and archery, whether none, limited, or extensive, and affirms they will only participate in activities within their skill level and in accordance with Club instructions and safety guidelines;
and
(H) That the Participant is 16 years of age or older. If Participant is signing on behalf of a minor under 16 years of age, the Participant affirms they are the minor’s parent or legal guardian and agrees to the terms herein on the minor’s behalf.
